There are few things sadder than the neglect and abuse of our elders in nursing and institutional homes. There are more than thirty four million over the age of 65 living in America today. Roughly one million seniors are mistreated or abused in some manner every year in the United States.
The incidence of nursing home abuse and litigation arising from abuse is on the rise. In February, a Coweta County, Georgia, jury awarded $550,000 in compensatory damages and $2.75 million in punitive damages to a neglected patient who was left in her room with her legs touching a heat register near her bed. She couldn't move off the register herself, and by the time the nursing home staff found her, she had suffered second-degree burns. When hospitalized, the woman was found to have undiagnosed pneumonia and a urinary tract infection.
This verdict is one of the latest in a series of substantial awards against the nursing home industry. Recently, there have been multi-million dollar verdicts in several states in the Gulf South. In Louisiana, just last December, a Louisiana appeals court upheld a $650,000 verdict against Plantation Management Corp. nursing facility finding that the facility's negligence led to a resident's leg amputation and ultimately her heart attack.**
