Workplace accidents happen. In 2000, there were 3,900,000 disabling workplace injuries and 5,200 unintentional workplace deaths in the United States.* Not surprisingly, the back is the part of the body most frequently injured at work. In the U.S., there are 11 unintentional deaths and 2,340 disabling injuries every hour during the year.* Many of these injuries and deaths occur on the job.
Under Louisiana law, an employee is generally not allowed to assert a personal injury claim against his or her employer for injuries occurring on the job. An employee's exclusive remedy for injuries caused by non-intentional acts or omissions by an employer is workers compensation. The workers compensation system is administered by special courts and the available recovery is substantially less than one could recover in a traditonal court of law. This is due, in part, to the fact that workers compensation law does not allow the recovery of non-economic damages such as pain and suffering.
Regardless, workers compensation law can compel an employer to authorize requested medical care, provide vocational rehabilitation or evaluate the severity of a workplace injury. Work place accidents can implicate other parties who sometimes cannot claim the benefit of the immunity afforded a direct employer.
